PILOT REGULATIONS (amended October 01 2005)

ART. 1.

1.1.

In order to use the flight equipment of the club, the pilot must be a Pilot-Member (Membre titulaire pilote), hold a valid private pilot licence (Airplane) or a valid training licence and hold qualifications valid for the category of aircrafts used, for the type of flight planned as well as for the infrastructure to be used. He/she must also not have been banned from flying.

1.1.1.

All pilots or holders of a training licence must present to the AERO-SPORT Management Board photocopies of their licences and qualifications. In case of revalidation or renewal of the licences and/or qualifications, a copy must be presented to the Management Board within two days after revalidation or renewal by the appropriate authorities.

All pilots, or holders of a training licence of whom the Management Board has not received a copy of the licences and/or qualification will be banned from flying. The name of any person banned from flying will be posted at AERO-SPORT.

This is a purely internal measure of AERO-SPORT and will in no way engage the responsibility of AERO-SPORT, neither for the deadline and means of obtaining, validating, revalidating or renewal, nor for possible carelessness, faults or frauds made for obtaining the validation, revalidation or the renewal of the licences and/or qualifications.

All pilots, or holders of a training licence:

· remain the only ones responsible for the validity of their licences and qualifications;

· must personally make sure to complete within the legal deadlines the adequate requests and steps for obtaining the validation, revalidation or the renewal of the licences and/or qualifications before expiration;

· must check the validity of their licences and qualifications before each flight with an AERO-SPORT aircraft.

1.2.

Moreover, the holder of a training licence (Private Pilot Airplane) must obtain the authorization of an approved AERO-SPORT instructor for all flights which he/she wishes to make.

1.3.

Any pilot who has not flown on a type of aircraft for 3 months or more must be checked out and certified on this type by an approved AERO-SPORT instructor. A record must be made in the pilot’s logbook and in the checkout register.

1.4.

To prevent being banned from flying on club aircraft, all pilots of AERO-SPORT must pass the "Biannual Flight Review" (BAFR) every two years with an approved AERO-SPORT instructor. The BAFR will coincide with the candidate’s date of birth within 3 months before and after. The year of birth, odd or even, will determine the year during which the pilot must undergo the BAFR. It is the pilot’s responsibility to request his/her BAFR within the given deadlines.

If the review is failed or not carried out, the pilot will be temporarily banned from flying club aircraft.

Exemptions from the check:

· flight instructors and trainee flight instructors;

· pilots having during the 6 months preceding the expiry:

- obtained their practical IFR qualification;

- made a successful check flight for the revalidation or the renewal of the IFR qualification;

- made a successful practical test for night flying;

- made a successful practical test for the PPL.

A check report will be given to the candidate and to the club office.

1.5.

The instructors and the members of the Management Board have authority to take all measures deemed necessary against any club member to guarantee safety.

ART. 2.

2.1.

The use of club aircraft is made under the sole responsibility of the pilot and at his/her own risk; it will in no case engage the responsibility of the Management Board, its members individually or the club.

2.2.

The pilot can only use the aircraft within the limits foreseen by the manufacturer, according to his/her qualifications and conforming to the Luxembourg legislation. The pilot in command, with the exception of the instructor, must occupy the left seat.

2.3

It is mandatory for all pilots to check the aircraft documents and the state of the aircraft before any flight, to consult the logbook as well as the incidents records, and to announce any fault noted before, during or after the flight to one of the persons in charge of maintenance or to the club office. All flights are prohibited where one suspects a fault or damage which endangers flight safety. The aircraft must be consigned on the ground by affixing the “No flying” notice, in all the cases where flight safety is not assured anymore, and the noted incident must be registered in the incident records. Pilots exceeding with a flight the engine time indicated for maintenance in the logbook, will be banned from flying pending a check flight with an instructor.

2.4.

In the event of an accident, AERO-SPORT reserves the right to demand the monetary value of the aircraft from the pilot, as determined by an expert, in case the all-risks insurance refuses to pay. In all cases where the responsibility of the pilot is engaged, he/she must pay the self participation and/or extra premiums, according to the decision of the Management Board.

2.5.

In the event of an incident or accident, the pilot in command must present a detailed written report to the Management Board as soon as possible, notwithstanding the legal provisions to which he/she must also conform.

2.6.

The insurance policies covering the club aircraft can be consulted freely by each member at the club office.

ART. 3.

3.1. Reservations

By reserving an aircraft, the pilot commits him- or herself to a minimum flight time, which is a third of the reserved period, with a two hour ceiling per day. If the minimum flight time is not reached, a supplement will be charged to the pilot, based on the “dry price” of the aircraft.

When weather conditions do not allow the minimum flight time to be reached, the pilot may request in writing the refund of the supplement charged. These requests are to be introduced to the Management Board as soon as possible after the return with a detailed proof of the weather conditions for each day.

Reservations will be automatically cancelled if the pilot does not show up 15 minutes after the start of his/her reservation. For reservations of more than one day, this time is 2 hours.

If a pilot is unable to use his/her reservation, he/she is required to inform the club office, or a member present at the club house, as soon as possible in order to cancel his/her reservation through the reservation program. If possible, he/she will also inform any person who might be registered in stand-by.

In the event of a pilot failing to inform the club of a cancellation of a reservation, the Management Board reserves the right to invoice 50% of the “dry price” to him/her.

3.2. Short Term Reservation

The short-term reservations must be entered into the reservation program.

3.3. Long-Term Reservations using the Reservation Board

For any reservations where the dates do not allow the entry into the reservation program, the long-term reservation board must be used. The Management Board’s approval is necessary for these reservations, which afterwards will be carried over to the reservation program by the club office. When the reservation is accepted, a lump sum of 10 Euro is charged to the pilot’s account.

3.4. Pick-up and Release

Each pilot is required to mark the "pick-up" in the reservation program at the time of taking over the aircraft as well as the "release" in the event of returning it before the time planned. Pilots who will not enter the “pick-up” into the reservation system, will be charged 10.- € per flight, respectively per day in case of long term reservations.

ART. 4.

4.1. Fuel Purchases Abroad

On presentation of the invoice, the value of fuel bought abroad will be refunded to the pilot for the same quantity at the price rate of the fuel in the Grand-Duchy of Luxembourg.

ART. 5.

5.1.

All pilots must return their aircraft to the hangar.

5.2.

In the event of flights abroad, the pilot must carry the equipment necessary to tie down the aircraft when and where necessary.

5.3.

All pilots must take responsibility for the upkeep and cleanliness of the club’s aircraft and buildings.

All pilots are required to clean the aircraft after each flight, in particular the windshield and the leading edges of the wings and the hull.

It is strictly forbidden to smoke on board or near the aircraft.

ART. 6.

6.1.

The price per hour of flight is set by the Management Board and is reviewed periodically. The invoiced flight time is read from the counter in the aircraft. Before departure, all pilots must check the value shown on the counter and the record in the aircraft’s logbook.

After the flight, logbook records must be entered in a correct and in a legible manner. The pilot’s full name, as well as the quantities of fuel and oil added must be registered.

ART. 7.

7.1.

It is forbidden to use the club aircraft for remunerated flights.

ART. 8.

8.1.

All pilot’s accounts must have a positive balance at any time.

8.2.

The club contributions, flight hours and any other sums due will be charged to the pilot account. Refunds will be credited to the same account. The pilot will regularly receive a statement of his/her pilot account, on which all operations carried out since the preceding statement will be recorded.

Moreover, the following monthly surcharges are applied as from the month following the statement:

15 Euro for a debit up to 250 euros.

30 Euro for a debit exceeding 250 euros.

In the event of a repeated negative balance, the Management Board will take the measures which it deems necessary and suitable, in particular banning the pilot from flying.

8.3.

The accounts statement is not an invoice. All Members are themselves responsible for supervision of their flight time in relation to the payments made, so the account has no negative balance at any time.

ART. 9.

9.1.

The Management Board reserves the right to modify or supplement these regulations at any time and is committed to informing the members as soon as possible.

9.2.

Any member who has not certified with his signature, preceded by the handwritten phrase “read and approved”, to have taken knowledge of these pilot regulations is banned from flying.
